Welcome to All Aggie. The terms “we,” “us,” and “our” refer to All Aggie. The All Aggie brand and these Services are operated by Wake Up Triad LLC.

All Aggie operates this store and website, including all related information, content, features, tools, products, and services, to provide you, the customer, with a curated shopping experience (the “Services”). All Aggie is powered by Shopify, which enables us to provide the Services to you.

These terms and conditions, together with any policies referenced herein (these “Terms of Service” or “Terms”), describe your rights and responsibilities when you use the Services.

Please read these Terms carefully. They include important information about your legal rights, including warranty disclaimers and limitations of liability.

By visiting, interacting with, purchasing from, or otherwise using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms or our Privacy Policy, you should not use or access the Services.

We make reasonable efforts to accurately display and describe our products.

However, colors and product appearance may vary depending on your screen, device settings, printing processes, materials, and normal production variations.

We do not guarantee that a product’s appearance will be identical to how it appears on your screen.

Products may be made to order. Minor variations that occur as a normal part of printing or manufacturing do not necessarily constitute defects.

Product descriptions, pricing, availability, specifications, and other information may be changed without notice.

We reserve the right to discontinue products and to limit product quantities available to any person, household, geographic region, or jurisdiction.

SECTION 3 - ORDERS

When you place an order, you are making an offer to purchase products from us.

We reserve the right to accept, reject, limit, or cancel an order as permitted by applicable law.

Your order is not considered accepted until we confirm acceptance and successfully process the applicable payment.

Please review your order carefully before submitting it. Because certain All Aggie products are made to order and may enter production shortly after purchase, we may be unable to accommodate cancellation or modification requests after an order is placed.

If we cancel or materially modify an order, we will attempt to notify you using the email address, phone number, billing information, or other contact information provided with your order.

Returns, refunds, replacements, and exchanges are governed by our Return & Refund Policy.

You represent that products purchased through the Services are for lawful personal or household use unless otherwise expressly agreed by us.

SECTION 4 - PRICES, PAYMENT AND BILLING

Prices, discounts, promotions, and product availability are subject to change without notice.

The price charged for a product will generally be the price displayed when your order is placed, subject to correction of errors as permitted by law.

Unless expressly stated otherwise, displayed product prices may not include applicable sales taxes or other governmental charges.

Where we offer free shipping, the applicable shipping charge will be displayed as free at checkout for qualifying orders.

You agree to provide current, complete, and accurate purchase, payment, and account information.

You represent and warrant that you are authorized to use any payment method submitted in connection with an order and that charges incurred through your purchase will be honored by the applicable payment provider.

SECTION 5 - SHIPPING AND DELIVERY

Certain All Aggie products are made to order and require production before shipment.

Processing, production, shipping, and delivery estimates displayed on our website or during checkout are estimates only and are not guaranteed delivery dates.

Delays may occur because of carriers, weather, holidays, high order volume, production conditions, customs, address issues, or other circumstances outside our reasonable control.

Available shipping methods, geographic restrictions, tracking availability, estimated delivery times, lost shipments, damaged shipments, and other delivery matters are governed by our Shipping Policy.

Shipping and delivery issues, including lost, damaged, delayed, or undeliverable packages, will be handled in accordance with our Shipping Policy and Return & Refund Policy.

Customers are responsible for providing an accurate and complete delivery address.

SECTION 6 - INTELLECTUAL PROPERTY

The Services, including text, graphics, photographs, product imagery, video, audio, designs, layouts, software, logos, trademarks, branding, and other content, are owned by All Aggie, Wake Up Triad LLC, their licensors, or other applicable rights holders and are protected by applicable intellectual property laws.

These Terms permit you to use the Services for personal, non-commercial purposes.

Unless expressly authorized, you may not reproduce, distribute, modify, publicly display, publicly perform, republish, download, store, sell, license, or transmit protected materials from the Services.

Nothing in these Terms grants you ownership of or a license to any trademark, copyright, patent, publicity right, or other intellectual property except as expressly stated.

All third-party names, logos, trademarks, designs, and other intellectual property appearing through the Services remain the property of their respective owners.

We may provide access to tools, features, applications, or services supplied by third parties.

Unless otherwise stated, we do not control those third-party tools and provide access to them on an “as is” and “as available” basis.

SECTION 9 - RELATIONSHIP WITH SHOPIFY

All Aggie is powered by Shopify, which enables us to provide the Services to you.

However, purchases made from the All Aggie store are transactions directly between you and All Aggie.

Shopify is not the seller of the products you purchase from All Aggie and is not responsible for the products, fulfillment, customer service, or other obligations arising from those purchases except to the extent separately provided by Shopify’s own services and terms.

To the extent permitted by applicable law, you acknowledge that Shopify and its affiliates are not responsible for claims arising solely from products purchased directly from All Aggie.

SECTION 10 - PRIVACY

Our collection, use, processing, retention, and disclosure of personal information is governed by our Privacy Policy.

Because our Services are powered by Shopify, Shopify may also collect and process certain information associated with your access to and use of the Services.

We reserve the right to correct errors, update information, or cancel affected orders when permitted by applicable law.

If an order is canceled after payment because of an error attributable to us, any applicable refund will be handled in accordance with our policies and applicable law.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ALL AGGIE, WAKE UP TRIAD LLC, AND THEIR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES OR PRODUCTS PURCHASED THROUGH THE SERVICES.

THIS MAY INCLUDE LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, OR SIMILAR DAMAGES.

THESE LIMITATIONS APPLY ONLY TO THE EXTENT PERMITTED BY APPLICABLE LAW. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OR EXCLUSIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

SECTION 18 - INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless All Aggie, Wake Up Triad LLC, and their affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from third-party claims, losses, damages, liabilities, and reasonable costs arising from your material violation of these Terms, applicable law, or another person’s rights.

SECTION 19 - SEVERABILITY

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed as necessary.

The remaining provisions will continue in full force and effect.

SECTION 20 - WAIVER AND ENTIRE AGREEMENT

Our failure to exercise or enforce a right under these Terms does not constitute a waiver of that right.

These Terms, together with policies and other terms incorporated by reference, constitute the agreement governing your use of the Services except where another written agreement expressly applies.

You may not transfer or assign your rights or obligations under these Terms without our prior written consent.

We may assign or transfer our rights and obligations in connection with a merger, acquisition, reorganization, sale of assets, financing, or other lawful business transaction, subject to applicable law.

SECTION 25 - SMS AND MOBILE MESSAGING

By providing your mobile phone number and affirmatively opting in to receive text messages from All Aggie, you consent to receive SMS or MMS communications at the number you provide.

Depending on the consent you provide, messages may include customer service communications, order updates, product announcements, special offers, promotions, and other All Aggie communications.

Consent to receive marketing text messages is voluntary and is not a condition of purchase.

Message frequency may vary. Message and data rates may apply.

You may opt out of SMS messages at any time by replying STOP. After receiving an opt-out request, we may send a final message confirming that you have been unsubscribed. You will not receive additional messages covered by that consent unless you opt in again.
